The analysis of financial services transactions with a view to determining the correct VAT treatment, particularly regarding the application of the exemptions set out in the VAT Directive has always been a challenging task.

To complicate matters, the EU VAT rules for financial services have remained unchanged notwithstanding the exponential growth of new financial services products on the market and the parallel evolution of technology that facilitates their uptake.
